Terms & Conditions
Welcome to Nest (“Nest”, “we”, “our”, “us”).
Nest is a shared life coordination application that allows users to create shared circles, calendars, reminders, and events for families, co-parenting arrangements, households, friends, and other groups.
By creating an account or using Nest, you agree to these Terms & Conditions.
1. Eligibility
You must be at least 18 years old to create an account and use Nest.
By using Nest, you confirm that:
- you are legally capable of entering into a binding agreement;
- the information you provide is accurate;
- you will comply with these Terms.
2. User Accounts
Users are responsible for:
- maintaining account confidentiality;
- protecting login credentials;
- all activity occurring under their account.
You agree not to:
- impersonate another person;
- share access unlawfully;
- use false information.
3. Circle Functionality
Nest allows users to create “Circles” and invite other users to collaborate.
By inviting members to a Circle, you acknowledge that:
- information added to that Circle may be visible to all Circle members;
- users are responsible for ensuring they have consent to share relevant information;
- Nest is not responsible for disputes between Circle members.
4. Acceptable Use
You agree not to:
- use Nest for unlawful purposes;
- harass, threaten, or abuse other users;
- upload malicious code or harmful content;
- interfere with the operation or security of the app;
- misuse notifications or invitation systems.
Nest reserves the right to suspend or terminate accounts violating these rules. See also our Acceptable Use Policy.
5. Event Information & Accuracy
Nest is a coordination and organisational tool only.
We do not guarantee:
- event accuracy;
- reminder delivery;
- uninterrupted availability;
- conflict detection accuracy.
Users remain responsible for verifying important schedules, appointments, and arrangements. Nest should not be relied upon for emergency communication or legal/custody compliance purposes.
6. Notifications
Nest may send:
- push notifications;
- reminders;
- alerts;
- scheduling conflict notifications.
Users can manage notification preferences within the app settings. Delivery timing may vary depending on device, internet connectivity, and third-party systems.
7. Intellectual Property
All Nest branding, software, designs, logos, and content are owned by Nest or its licensors.
Users may not:
- copy;
- distribute;
- reverse engineer;
- reproduce;
- commercially exploit
any part of the platform without written permission.
8. Privacy
Your use of Nest is also governed by our Privacy Policy and POPIA Privacy Notice. By using Nest, you consent to the collection and processing of your information as described in those policies.
9. Third-Party Services
Nest may use third-party providers including:
- Firebase
- cloud hosting services
- analytics providers
- notification providers
These services may process data on our behalf.
10. Limitation of Liability
To the maximum extent permitted by law, Nest shall not be liable for:
- missed events;
- scheduling conflicts;
- data loss;
- indirect or consequential damages;
- disputes between users;
- service interruptions.
Use of the app is at your own risk.
11. Account Suspension & Termination
We reserve the right to:
- suspend;
- restrict;
- terminate
accounts that violate these Terms or misuse the platform. Users may delete their account at any time.
12. Changes to the Service
Nest may:
- modify features;
- add or remove functionality;
- discontinue services;
- update pricing
at any time.
13. Changes to These Terms
We may update these Terms periodically. Continued use of Nest after updates constitutes acceptance of the revised Terms.
14. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of South African courts.
